DSAW Waiver, Release of Liability & Photo/Media Policy

Please read carefully — this is a legal document that affects your rights.

By registering for or participating in a Down Syndrome Association of Wisconsin (DSAW) event,
you acknowledge that you have read, understand, and agree to the terms outlined below.

Voluntary Participation & Understanding of Risk

Participation in DSAW events is voluntary. DSAW events may include physical activity or movement,
group interaction, food and beverage consumption, indoor or outdoor activities, and participation
in public or shared spaces.

These activities involve inherent risks, including but not limited to:

  • Slips, falls, or physical injury
  • Interaction with other participants, volunteers, staff, or members of the public
  • Use of equipment, facilities, or event spaces
  • Food and beverage consumption
  • Weather-related conditions
  • Transportation to and from the event

These risks may result in property damage, personal injury, serious injury, illness, or death.
You understand that medical personnel may not be available at all events and that you are
responsible for exercising reasonable care for your own safety and the safety of those in your care.

Assumption of Risk

To the fullest extent permitted under Wisconsin law, you knowingly and voluntarily assume all risks,
whether known or unknown, associated with participation in DSAW events, including risks that may
arise from the ordinary negligence of DSAW or others.

Release of Liability

To the fullest extent permitted by Wisconsin law, you agree to release, waive, and discharge the
Down Syndrome Association of Wisconsin, Inc., its chapters, and their respective officers, directors,
board members, employees, volunteers, representatives, and agents from any and all claims, demands,
damages, or causes of action arising out of or related to participation in the event.

This includes claims arising from the ordinary negligence of DSAW.

Important: This release does not apply to gross negligence, reckless conduct,
or intentional misconduct, which cannot be waived under Wisconsin law.

Participation of Minors

If you are registering a minor, you confirm that you are the parent or legal guardian and consent
to their participation.

You acknowledge that the same inherent risks apply to minors and that you are responsible for
their supervision and safety.

You understand that, under Wisconsin law, a parent or guardian may not fully waive a minor’s future
personal injury claims. However, by agreeing to this waiver, you acknowledge the risks and accept
participation under these terms to the fullest extent permitted by law.

Responsibility & Conduct

You agree to:

  • Follow all event rules, instructions, and safety guidelines
  • Act in a safe and respectful manner
  • Supervise any minor or participant in your care
  • Remove yourself or your participant from activity if safety becomes a concern

DSAW reserves the right to remove any participant whose conduct poses a risk to themselves or others.

Indemnification

You agree to indemnify and hold harmless DSAW from any loss, liability, damage, or expense,
including reasonable attorney’s fees, arising from:

  • Your participation in the event
  • The participation of a minor or participant in your care
  • Your failure to follow event rules, instructions, or safety guidelines

Photo, Video & Media Use

DSAW may take photos, video, audio recordings, or other media at events to support its mission
through communications, outreach, fundraising, public relations, social media, and promotional efforts.

If you consent, you grant DSAW permission to use images, video, audio, and names — yours and/or
your participant’s — for these purposes, without compensation or additional notice.

This consent is intended to serve as valid written consent under
Wisconsin Statutes § 995.50, Right of Privacy.

Public Space Notice

If you choose not to consent to photo or video use, DSAW will make reasonable efforts not to
capture or publish images of you or your participant in DSAW-produced materials.

However, DSAW cannot control photography or recordings taken by other attendees, venue staff,
media, or members of the public, especially at events held in public or shared spaces.

Severability & Governing Law

If any portion of this agreement is found to be invalid or unenforceable, the remaining provisions
shall remain in full force and effect.

This agreement shall be governed by and interpreted under the laws of the State of Wisconsin.

Your Agreement

By selecting “I agree” during registration, you confirm that:

  • You have read and understand this Waiver, Release of Liability, and Photo/Media Policy
  • You agree to its terms voluntarily
  • You understand that you are giving up certain legal rights
  • If registering a minor, you are the parent or legal guardian and consent to their participation
